Conway Travel Collective LLC · Effective June 6, 2026

PLEASE READ CAREFULLY. THESE TERMS & CONDITIONS CONTAIN IMPORTANT INFORMATION ABOUT YOUR LEGAL RIGHTS, INCLUDING YOUR WAIVER OF LIABILITY AND ASSUMPTION OF RISK RELATING TO EXPOSURE TO COVID-19 AND ANY OTHER COMMUNICABLE OR INFECTIOUS DISEASE, CLASS-ACTION WAIVER, AND AGREEMENT TO BINDING ARBITRATION.

These Terms and Conditions (“Terms and Conditions”) govern the relationship between Conway Travel Collective LLC (“CTC” and/or “we/us/our”) and you, the purchaser or traveler (“Client” and/or “passenger” and/or “guest” and/or “you/your”). By affirmatively checking the acknowledgment box during the booking process, you agree to be bound by these Terms and Conditions, including the Arbitration Agreement and Class Action Waiver, and acknowledge that CTC acts solely as a booking agent for disclosed principal supplier tour operators, cruise lines, hotels, airlines, air charters, bus companies, ground transportation, boat purveyors or owners, and other independent contractors providing accommodations, transportation, and other services (“Supplier(s)”) and is not the source or provider of the travel services.

NOTICE OF ARBITRATION AGREEMENT AND CLASS ACTION WAIVER: These Terms and Conditions contain a binding arbitration clause and class action waiver that affect your legal rights. Please read the Binding Arbitration and Class Action Waiver sections carefully before completing your booking.

Governing Law

These terms and conditions shall be governed by the laws of the State of Florida.

Use of CTC Services, Access and Information for Travel Bookings

You warrant that you are at least 18 years of age and possess the legal authority to enter into this Agreement and to make travel bookings with CTC. You agree to be financially responsible for all travel bookings you make with us, whether made on behalf of yourself or for other members of your traveling party. You warrant that all information supplied by you on behalf of yourself, members of your household, or others for whom you are authorized to transact business with us is true and accurate. You agree that you will only make legitimate reservations or purchases with CTC and its Suppliers, and you acknowledge that, without limitation, any speculative, false, or fraudulent reservation is prohibited.

CTC accepts all bookings solely as the booking agent for the travel Suppliers on your itinerary. Separate Supplier terms and conditions will apply to your reservation and purchase of travel-related goods and services that you select, and you understand and agree that by booking travel through CTC, you are also agreeing to the booking terms of each Supplier partner you have selected for your itinerary. You agree that you will abide by the terms and conditions of purchase imposed by any Supplier that you have selected as a service provider on an itinerary you have approved.

CTC is not liable or responsible for any arrangements made independently of CTC. CTC assumes no responsibility for costs or fees you incur for independent arrangements not booked through CTC, inclusive of, but not limited to, airline, hotel, excursion, and travel protection related charges. If you make your own flight arrangements, CTC is not responsible for any loss resulting from cancellation or changes in international gateways, itineraries, or travel dates, and cannot assist you with any schedule changes or delays related to air reservations you have made on your own arrangement. It may not be possible to earn frequent flyer or other loyalty points for reservations on your itinerary. With limited exceptions, hotel and airline rewards or points cannot be redeemed for travel arrangements made by CTC.

Reservation of Rights and Changes to These Terms

We reserve the right, in our sole discretion, to change these Terms and Conditions at any time. Updated versions of the Terms will be posted on our website and are effective immediately on posting.

General

The laws of the State of Florida govern these Terms and Conditions. You hereby consent to the exclusive jurisdiction and venue of courts in Orange County, Florida in all disputes arising out of or relating to travel bookings with CTC. Any claim against CTC must be commenced no later than one (1) year from the earlier of: (a) the date of trip completion; (b) the scheduled departure date if the trip did not occur; or (c) the date on which Client knew or reasonably should have known of the facts giving rise to the claim, whichever occurs first; except that claims under the Florida Deceptive and Unfair Trade Practices Act (Fla. Stat. § 501.201 et seq.) shall be governed by the applicable limitations period under Florida law, currently four (4) years from the date of accrual. CTC shall not in any case be liable for damages other than compensatory damages, and you waive any right to claim punitive or exemplary damages.

If any part of these Terms and Conditions is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the agreement shall continue in effect.

These Terms and Conditions constitute the entire agreement between the Client and CTC with respect to travel bookings made with CTC by any means, and supersede all prior or contemporaneous communications and proposals, whether electronic, oral, or written, between Client and CTC.

General Conditions and Responsibility

CTC, its founders, directors, officers, employees, subcontractors, agents and representatives, shall at no time be liable or responsible in any way whatsoever for any loss, injury, or damage caused or arising in connection with any services provided by CTC and its suppliers, or as a result of acts of God, acts of Government or other authorities, pandemic or other health and safety circumstance, wars, civil disturbances, hijacks, thefts, or any circumstance beyond its control.

Notwithstanding the foregoing, this limitation of liability does not apply to, and CTC does not seek to disclaim liability for: (a) the gross negligence or willful misconduct of CTC or its officers, employees, or agents; (b) intentional torts committed by CTC or its officers, employees, or agents; (c) claims arising under the Florida Deceptive and Unfair Trade Practices Act (Fla. Stat. § 501.201 et seq.); or (d) any liability that cannot be disclaimed as a matter of applicable Florida law.

Right to Correct Errors and Offers Subject to Availability

We reserve the right to correct errors. In the event of any pricing error or omission, we reserve the right to adjust such pricing or make any other corrections. All offers, incentives and Supplier promotions are subject to availability and may change without notice. You are advised to confirm reservations well in advance of your anticipated dates of travel to avoid disappointment, increases in fares and additional late booking fees.

Payments, Cancellations, and Changes to Bookings

You shall be completely responsible for all charges, fees, duties, taxes, and assessments arising out of your travel bookings through CTC. By submitting a credit card authorization form to CTC, you agree to allow CTC to use your payment method to purchase travel products from our Suppliers on your behalf. Nothing in these Terms & Conditions limits Client’s right to dispute charges with Client’s credit card issuer as permitted by applicable federal law, including the Fair Credit Billing Act. However, Client agrees that before initiating a chargeback, Client will first contact CTC in writing to attempt resolution of any billing dispute.

EXCEPTING IN CASES OF FRAUD OR NON-DELIVERY OF SERVICES, YOU AGREE NOT TO FILE ANY DISPUTE WITH YOUR BANK OR CREDIT CARD COMPANY TO AVOID OR VIOLATE ANY BOOKING TERMS AND CONDITIONS OF CTC OR ITS SUPPLIERS, INCLUDING CANCELLATIONS OR CHANGES OF ITINERARY OR ARRANGEMENTS FOR REASONS BEYOND THE CONTROL OF CTC OR ITS SUPPLIERS. IF YOU ATTEMPT TO CHARGEBACK, REVERSE OR RECOLLECT A PREVIOUSLY AUTHORIZED TRIP PAYMENT IN VIOLATION OF THESE TERMS, CTC RESERVES THE RIGHT TO COLLECT ALL ADDITIONAL COSTS, FEES AND EXPENSES ASSOCIATED WITH SUCH CHARGEBACK, REVERSAL OR RECOLLECTION, INCLUDING, WITHOUT LIMITATION, ATTORNEY FEES. CTC’S 10% SERVICE FEE IS EARNED UPON BOOKING CONFIRMATION AND IS NON-REFUNDABLE EXCEPT AS EXPRESSLY STATED IN THESE TERMS AND CONDITIONS.

All payments for travel are due prior to departure according to each Supplier’s terms and conditions of booking. You understand that failure to make final payment or any violation of a Supplier’s conditions of purchase may result in cancellation of your reservations, in your being denied access to any flights, tours, hotels, cruises, or other travel services, or in your forfeiting any monies paid for your reservations. In some cases, there is NO REFUND once a booking is made and under deposit. All cancellation requests must be sent to CTC in writing.

If you choose to cancel a trip/booking made by CTC you are subject to a 10% cancellation fee, imposed by CTC, that will be charged to the credit card or other payment method you authorized to pay for travel services, and is in addition to any fees outlined in the supplier’s terms and conditions.

If you decide to change any portion of your confirmed arrangements prior to departure or during your trip, we will attempt to assist you. All requests for changes to a booking must be made in writing to CTC. When tour, cruise or package prices are based on Suppliers’ contract rates, you will not be entitled to any refund for any unused portion of travel.

Travel Documents, Including TSA and DHS Acceptable Identification Requirements

It is the responsibility of each Client to obtain and carry a valid passport book, visa(s), and all other documents required by applicable government regulations. Passport cards are not accepted for most international travel. When traveling domestically or internationally, the U.S. Transportation Security Administration (TSA) and U.S. Department of Homeland Security (DHS) advise that everyone carry acceptable identification in order to board a flight. Acceptable identification can be found at www.tsa.gov.

Certain countries will not admit a passenger if their passport expires within six (6) months of the anticipated date of return. Non-United States citizens may require additional documentation, and you are responsible to make CTC aware when traveling on a passport from a country other than the United States of America. CTC neither controls nor warrants the issuance of visas or approval of visa waivers related to your travel. Should a visa not be issued, CTC is not responsible for lost payments made toward your trip.

Children and infants may also require travel documents. Minors traveling with one parent, and/or without both parents, may be stopped and not admitted, unless authenticated and verified consent forms are provided to the authorities; please see help.cbp.gov for additional information.

The name, date of birth and gender that appears on the identification card must exactly match the same such data that is listed on your tickets and booking records.

WHEN YOU RECEIVE YOUR TRAVEL DOCUMENTS, IT IS YOUR RESPONSIBILITY TO REVIEW AND VERIFY ALL INFORMATION FOR ACCURACY. CONTACT CTC IMMEDIATELY IF CHANGES OR CORRECTIONS ARE REQUIRED. IF YOU HAVE NOT NOTIFIED US OF NECESSARY CORRECTIONS TO YOUR RESERVATION WITHIN TWENTY-FOUR (24) HOURS OF RECEIVING YOUR TRAVEL DOCUMENTS, CTC BEARS NO RESPONSIBILITY FOR ANY ADDITIONAL COSTS ASSOCIATED WITH MAKING NECESSARY CORRECTIONS.

Individual Entry and Exit Requirements

Each country holds different views of past criminal offenses, whether within or outside of their boundaries. If you have a current or prior criminal offense, contact that country directly for entry and exit requirements. You can visit the US State Department Website for further information: travel.state.gov. We do not inquire about an individual’s criminal record in the interest of respecting our Clients’ privacy.

Immunizations and Health Screenings

You must have the proper immunizations and health screenings and required documentation of such immunizations and screenings before travel. CTC shall not assume responsibility for the accuracy of health, vaccination, or documentation requirements prior to departure or upon landing at the final destination. In some cases, required inoculations must be recorded by Client’s health practitioner on a valid vaccination certificate, which the Client must carry for proof of inoculation. If you are concerned about taking any medications or receiving certain inoculations, check with your health practitioner BEFORE booking. Check the State Department website and the Center for Disease Control for relevant health and travel information.

Accessibility, Travelers with Disabilities, Special Travel Needs

Travelers with disabilities or special needs who may require non-emergency special services, additional support or accommodation of a disability should advise us in advance of booking, so that we can request assistance or arrange for appropriate services or equipment. In some cases when travelers are unable to use their own wheelchairs, mobility devices, medical equipment or devices, rental of special equipment or devices may result in additional charges.

Certain destinations may have limited medical facilities or limited availability of prescription medications. We recommend that you consult with your health practitioner to discuss the details of your trip.

WE RECOMMEND THE PURCHASE OF COMPREHENSIVE TRAVEL INSURANCE ON ALL BOOKINGS.

Risks and Safety

Travel to certain destinations may involve greater risk than others. CTC urges Clients to remain informed daily as to current news events, as well as to review travel prohibitions, warnings, announcements and advisories issued by the United States Government prior to booking travel to international destinations. Information can be found at state.gov, tsa.gov, cdc.gov, and via the Smart Traveler Enrollment Program (STEP).

BY OFFERING FOR SALE TRAVEL TO PARTICULAR DESTINATIONS, CTC DOES NOT REPRESENT OR WARRANT THAT TRAVEL TO SUCH POINTS IS ADVISABLE OR WITHOUT RISK, AND SHALL NOT BE LIABLE FOR COSTS, DAMAGES, OR LOSSES THAT MAY RESULT FROM TRAVEL TO SUCH DESTINATIONS. CLIENT’S PARTICIPATION CONSTITUTES ACCEPTANCE OF SUCH EVENTS AT CLIENT’S OWN RISK.

Hazardous Materials

Federal law prohibits passengers from bringing hazardous materials on the aircraft. A violation can result in five years’ imprisonment and penalties of $250,000 or more (49 U.S.C. 5124). Hazardous materials include explosives, compressed gases, flammable liquids and solids, oxidizers, poisons, corrosives and radioactive materials. There are special exceptions for small quantities (up to 70 ounces total) of medicinal and toilet articles. For further information, contact your airline representative(s). Restrictions are listed at tsa.gov/traveler-information/prohibited-items.

Air Travel, Schedule Reconfirmation, Check-In

Your airline ticket is a contract between you and the air carrier, even if you purchase through CTC. CTC does not have the right to control the operations of independent airlines and is not liable for any personal injury or property damage related to your purchase of air tickets or air travel, including any act, error, omission, injury, loss, accident, delay, airline policies, fees, fuel increases, bankruptcy, or cessation of operations.

Due to enhanced security, it is strongly recommended that you check in a minimum of 2 hours prior to scheduled departure for domestic flights and 3 hours prior to scheduled departure time for international flights. Reconfirm flight times at least 24 hours prior to scheduled departure time for domestic flights, and 72 hours prior for international flights.

Frequent Flyer mileage accrual is at the discretion of the airline(s). CTC has no liability if accrual of miles or points is denied or if upgrades are not allowed. Seat assignments are not guaranteed even after they are assigned, and CTC has no control over airline seat assignments.

Limitations of Responsibility and Disclosure

CTC acts solely as a booking agent for disclosed principal Suppliers and is not the source or provider of any travel service. Each Supplier is an independent entity with its own management and is not subject to the control of CTC.

BECAUSE CTC ACTS AS AGENT FOR DISCLOSED PRINCIPAL SUPPLIERS AND DOES NOT HAVE THE RIGHT TO CONTROL THE OPERATIONS OF SUCH INDEPENDENT OPERATORS AND SUPPLIERS, YOU AGREE THAT CTC IS NOT LIABLE FOR ANY PERSONAL INJURY OR PROPERTY DAMAGE, WHICH MAY ARISE OUT OF THESE SERVICES. CTC HEREBY DISCLAIMS ANY LIABILITY WHETHER BASED ON CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE, INCLUDING WITHOUT LIMITATION LIABILITY FOR ANY DIRECT, PUNITIVE, SPECIAL CONSEQUENTIAL, INCIDENTAL OR INDIRECT DAMAGES IN CONNECTION WITH THE GOODS OR SERVICES PROVIDED BY ANY PRINCIPAL SUPPLIER BOOKING THROUGH CTC, INCLUDING WITHOUT LIMITATION LIABILITY FOR ANY ACT, ERROR, OMISSION, INJURY, LOSS, ACCIDENT, DELAY OR IRREGULARITY WHICH MAY BE INCURRED THROUGH THE FAULT, NEGLIGENCE, WILLFUL ACTS, OMISSIONS OR OTHERWISE OF SUCH SUPPLIER, OR OF ANY SUPPLIER OR THEIR RESPECTIVE EMPLOYEES, AGENTS, SERVANTS, OR REPRESENTATIVES, INCLUDING, WITHOUT LIMITATION, THEIR FAILURE TO DELIVER OR THEIR PARTIAL OR INADEQUATE DELIVERY OF SERVICES, THEIR CANCELLATION AND REFUND POLICIES, FUEL INCREASES, BANKRUPTCY, OR CESSATION OF OPERATIONS AND OTHER MATTERS OUTSIDE OF CTC’S CONTROL, AND YOU HEREBY EXONERATE CTC FROM ANY LIABILITY WITH RESPECT TO THE SAME. CTC HAS SOLELY RECEIVED COMMISSION AND FEES FOR TRAVEL TRANSACTIONS AND CLIENT AGREES AND UNDERSTANDS THAT ANY RECOVERY FROM CTC WILL BE LIMITED TO THE AMOUNT OF COMMISSION AND FEES ACTUALLY RECEIVED BY CTC.

Consumer Protection Rights Preserved

Nothing in these Terms & Conditions shall be construed to waive, limit, disclaim, or release any rights that Client may have under: (a) the Florida Deceptive and Unfair Trade Practices Act (Fla. Stat. § 501.201 et seq.); (b) the Florida Seller of Travel Act (Fla. Stat. §§ 559.927–559.9355); (c) the Florida Digital Bill of Rights (Fla. Stat. Ch. 501, Part II); or (d) any other consumer protection statute that, by its terms, may not be waived by private agreement. All limitations of liability, releases, and exculpatory clauses in these Terms & Conditions apply solely to contract and common law tort claims and only to the maximum extent permitted by applicable law. Client’s statutory remedies are expressly preserved.

Force Majeure

(a) Definition

A “Force Majeure Event” means any event beyond the reasonable control of the affected party, including but not limited to: acts of God; natural disasters; earthquakes; floods; fire; epidemics; pandemics (including COVID-19 and future variants); government acts, orders, or regulations; travel advisories or restrictions issued by any governmental authority; war; terrorism; civil unrest; labor disputes; supplier insolvency or cessation of operations; utility failures; or any other cause beyond the party’s reasonable control, provided that such event could not have been prevented by the exercise of reasonable diligence.

(b) Notice

The party asserting a Force Majeure Event shall provide written notice to the other party within five (5) business days of becoming aware that a Force Majeure Event is affecting or is likely to affect performance. Notice shall describe: (i) the nature of the Force Majeure Event; (ii) the expected duration; and (iii) the services affected.

(c) Effect on Performance

Upon a Force Majeure Event, CTC’s obligation to perform the affected services is suspended for the duration of the Force Majeure Event. CTC shall use commercially reasonable efforts to mitigate the effects of the Force Majeure Event, including by seeking supplier credits, alternative arrangements, or refunds on Client’s behalf.

(d) Refunds

CTC shall use commercially reasonable efforts to recover amounts paid to suppliers and shall pass through to Client any refunds or credits actually received from suppliers, less CTC’s documented and reasonable out-of-pocket costs incurred in connection with the affected booking. CTC’s service fee is earned upon booking confirmation and is non-refundable except as expressly provided in subsection (e) below.

(e) Termination for Prolonged Force Majeure

If a Force Majeure Event continues for more than sixty (60) consecutive days and the affected services cannot reasonably be rescheduled within a mutually agreed timeframe, either party may terminate the affected booking by written notice. Upon termination under this subsection, CTC shall refund to Client any amounts recovered from suppliers within thirty (30) days of receipt, less CTC’s documented out-of-pocket costs.

(f) Supplier Force Majeure

Each of CTC’s Suppliers may have their own terms and conditions that include Force Majeure provisions. In the event that a Force Majeure event affects a Supplier, that Supplier may, in its sole and absolute discretion, vary, postpone, or cancel any itinerary or arrangement. CTC shall use its reasonable efforts to secure reimbursement for Client where possible.

THE PURCHASE OF TRAVEL INSURANCE IS HIGHLY RECOMMENDED ON ALL TRIPS.

Client Conduct

When you book with CTC, you accept responsibility for any damage or loss caused by you. Full payment for any such damage or loss must be paid directly at the time to the accommodation owner or manager or other Supplier. You must indemnify CTC for the full amount of any claim (also including legal costs) made against us. Baggage and personal effects are at all times the sole responsibility of the participant.

Any transportation, possession or use of illegal drugs will result in immediate termination of your trip and may result in prosecution by law enforcement authorities. You are responsible for knowing and observing the licensing laws for drug possession for all countries and states you are visiting.

Travel Insurance

CTC OFFERS ACCESS TO TRAVEL INSURANCE TO PROTECT PASSENGERS AND THEIR INVESTMENT IN TRAVEL. UNLESS SPECIFICALLY NOTED, TRAVEL INSURANCE IS NOT INCLUDED IN THE COST OF CLIENT’S ITINERARY TO PROTECT AGAINST THIRD PARTY SUPPLIER DEFAULT/BANKRUPTCY PROTECTION, DELAY, INTERRUPTION, MISSED CONNECTION FOR CRUISES, CANCELLATION, MEDICAL EMERGENCY TRANSPORTATION/EVACUATION & REPATRIATION, BAGGAGE & PERSONAL EFFECTS/LOST LUGGAGE & BAGGAGE DELAY, ILLNESS, JOB LOSS PROTECTION AND CHANGE OF PLANS, ACCIDENTAL DEATH AND DISABILITY, TRAVEL ACCIDENT/SICKNESS MEDICAL EXPENSES, AND MORE. PROPER INSURANCE MAY PROTECT YOU FROM FINANCIAL LOSS IN ALMOST ALL CIRCUMSTANCES.

Without appropriate travel insurance, you understand and agree that if you cancel or interrupt your travel for any reason, portions of the trip/tour may not be refunded and CTC’s and travel Suppliers’ cancellation penalties will apply resulting in the loss of monies up to the full cost of Client’s travel booking and related costs. The purchase of travel insurance is not required in order to purchase any other product or service offered by CTC.

COVID-19 and Communicable Disease Risk Assumption and Release

This section requires a separate acknowledgment checkbox during the booking process.

NOTICE: BY COMPLETING YOUR BOOKING AND CHECKING THE ACKNOWLEDGMENT BOX FOR THIS SECTION, CLIENT VOLUNTARILY ASSUMES THE RISKS DESCRIBED BELOW AND AGREES TO THE RELEASE OF CLAIMS SET FORTH HEREIN.

Assumption of Risk

Client acknowledges that an inherent risk of exposure to COVID-19 and any other communicable or infectious disease exists in any public place where people are present. COVID-19 is an extremely contagious communicable disease that can lead to severe illness and death. No precautions can eliminate the risk of exposure to COVID-19, and the risk of exposure applies to everyone.

By completing the booking process, Client agrees to voluntarily assume any and all risks in any way related to exposure to COVID-19 and any other communicable or infectious disease, including illness, injury, or death of Client or others. Client acknowledges that use of CTC’s services is entirely voluntary.

Waiver and Release

On Client’s own behalf and on behalf of Client’s heirs, executors, personal representatives, administrators, and assigns, Client agrees to forever waive, covenant not to sue, release, and discharge the Released Parties from any and all liability, claims, causes of action, damages, costs, or expenses of every kind arising out of or in any way relating to exposure to COVID-19 and any other communicable or infectious disease during Client’s participation in services provided by CTC and its suppliers.

THIS RELEASE DOES NOT APPLY TO, AND CTC DOES NOT SEEK TO DISCLAIM LIABILITY FOR, CLAIMS ARISING FROM THE GROSS NEGLIGENCE, RECKLESSNESS, OR WILLFUL MISCONDUCT OF CTC OR ITS OFFICERS, EMPLOYEES, OR AGENTS, CONSISTENT WITH FLORIDA PUBLIC POLICY.

Waiver of Unknown Claims

Client expressly waives any right or benefit Client may have under any statute or common law principle to the effect that a general release does not extend to claims that Client does not know or suspect to exist at the time of executing this agreement, to the fullest extent permitted by Florida law.

Released Parties

The Released Parties are: Conway Travel Collective LLC; and their respective parents, subsidiary, and other affiliated or related companies, and all founders, officers, directors, employees, shareholders, members, agents, contractors, sub-contractors, representatives, successors, assigns, insurers, and volunteers of each of the foregoing entities.

ACKNOWLEDGMENT: I have read and understand the COVID-19 and Communicable Disease Risk Assumption and Release above, and I voluntarily agree to its terms on behalf of myself and all travelers included in my booking. I understand that this release does not cover gross negligence, recklessness, or willful misconduct by CTC. (This box must be checked to complete your booking.)

Binding Arbitration

I AGREE THAT, UPON ELECTION BY EITHER PARTY, ANY DISPUTE, CLAIM, OR CONTROVERSY ARISING UNDER OR RELATING IN ANY WAY TO THE COVID-19 AND COMMUNICABLE DISEASE RISK ASSUMPTION AND RELEASE ABOVE OR EXPOSURE TO COVID-19 AND ANY OTHER COMMUNICABLE OR INFECTIOUS DISEASE DURING MY USE AND/OR PARTICIPATION IN SERVICES PROVIDED BY CTC AND ITS SUPPLIERS, NOW OR IN THE FUTURE, WILL BE RESOLVED BY BINDING ARBITRATION. I ACKNOWLEDGE AND AGREE THAT ARBITRATION REPLACES MY RIGHT TO GO TO COURT. I THEREFORE AGREE TO WAIVE ANY RIGHT TO A JURY TRIAL OR TO LITIGATE ANY CLAIMS IN COURT BEFORE A JUDGE OR JURY.

Any dispute, claim, or controversy arising out of or relating to these Terms and Conditions, any booking or transaction made with CTC, or the breach, termination, enforcement, interpretation, or validity thereof (collectively, “Dispute”), shall be determined by binding arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules then in effect. The AAA Consumer Arbitration Rules are available at www.adr.org or by calling 1-800-778-7879. The arbitration shall be conducted by a single, neutral arbitrator in Orange County, Florida (or telephonically/by videoconference upon request).

The costs and fees of the arbitration shall be allocated in accordance with the AAA Consumer Arbitration Rules, except that CTC shall pay all AAA filing, administrative, and arbitrator fees for any claim that does not exceed $10,000, provided the claim is not determined by the arbitrator to be frivolous. For claims exceeding $10,000, the arbitrator shall allocate fees consistent with the AAA Consumer Arbitration Rules. No fee allocation shall operate to render arbitration cost-prohibitive for the consumer.

Notwithstanding the foregoing, either party may seek emergency injunctive or provisional relief in a court of competent jurisdiction to preserve the status quo pending arbitration. Either party may also elect to have any individual claim heard in small claims court of competent jurisdiction in Orange County, Florida, or the jurisdiction where the Client resides, so long as the action remains in small claims court.

Class Action Waiver

YOU AND CTC AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS ACTION, CLASS ARBITRATION, COLLECTIVE ACTION, REPRESENTATIVE ACTION, OR MULTI-PARTY ARBITRATION PROCEEDING. THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON’S CLAIMS, AND MAY NOT OTHERWISE PRESIDE OVER ANY FORM OF A REPRESENTATIVE OR CLASS PROCEEDING. IF A COURT OR ARBITRATOR DETERMINES THAT THE CLASS ACTION WAIVER IS UNENFORCEABLE WITH RESPECT TO ANY CLAIM OR DISPUTE, THEN THE CLASS ACTION WAIVER SHALL BE SEVERABLE FROM THIS ARBITRATION AGREEMENT AND THAT CLAIM OR DISPUTE SHALL PROCEED IN A COURT OF COMPETENT JURISDICTION, NOT IN ARBITRATION.

Nothing in this Class Action Waiver shall be construed to prevent any party from pursuing individual claims under the Florida Deceptive and Unfair Trade Practices Act (Fla. Stat. § 501.201 et seq.) on an individual basis in arbitration.

Include: your full name, the email address associated with the booking, and your booking confirmation number. The opt-out notice must be postmarked or emailed within thirty (30) days of your first booking with CTC.

If you opt out of arbitration, all other provisions of these Terms and Conditions remain in full force and effect. If you do not opt out within the Opt-Out Deadline, you will be deemed to have consented to binding arbitration as set forth above.

Privacy Policy

Client’s use of CTC’s services is also governed by CTC’s Privacy Policy, available at www.conwaytravelcollective.com/privacy, which is incorporated by reference into these Terms & Conditions. By engaging CTC’s services, Client acknowledges having reviewed the Privacy Policy. CTC collects and processes personal data as described therein in compliance with applicable Florida and federal privacy laws, including the Florida Digital Bill of Rights (Fla. Stat. Ch. 501, Part II).
